2011-09-14  |  Authentic court documents pertaining to the waiver of claims by Dariusz Michalczewski.

Contrary to the assertions made by Dariusz Michalczewski, that he has not withdrawn his claims, court documents say otherwise.

Dariusz Michalczewski filed an action for transfer onto him of the rights to the “T.G.R. Energy Drink” trademark on the basis of his trademark, i.e. "Dariusz Tiger Michalczewski", reserved at OHIM (The Office of Harmonization for the Internal Market), a body registering trademarks in the European Union. The action, filed in Kraków, covering the rights to the “T.G.R. Energy Drink” trademark and claims arising from the “Dariusz Tiger Michalczewski” trademark, was subsequently transferred in accordance with the court’s competence to the Regional Court in

 

Warsaw (22nd Community Trademarks Division) (decision of 20.02.2010).

Before the Regional Court in Warsaw, the attorney acting for Dariusz Michalczewski withdrew the action, waiving claims against FoodCare sp. z o.o. contained in the action, i.e. claims for the transfer of the rights to the “T.G.R. Energy Drink” trademark and claims arising from the “Dariusz Tiger Michalczewski” trademark (record of the hearing held on 25 July 2011). In view of the withdrawal of the action and the waiver of claims the Regional Court in Warsaw discontinued the proceedings (decision of 25 July 2011, XXII Gwzt 14/11). Under such circumstances, the action may not be re-filed.

 

The case concerning the rights to the “T.G.R. Energy Drink" Community trademark is no longer pending before the Polish Patent Office, as this is not a competent instance. Such proceedings are also not pending before the OHIM, but we would not be surprised if another action were to be brought following the publication of this information.

Considering the low substantive value of arguments, opponents try to improve their positions in the media by multiplying motions and legal actions, which in most cases are used for the purpose of media communication (or media noise, as Dariusz Michalczewski calls it). However, they withdraw their claims quickly, as in the above case.

We expect that the action of the Foundation for PLN 10 million and the fourth application filed by Dariusz Michalczewski on 9 September 2011 with the trademarks court, also after making use of media communication, will be withdrawn (as happened in July in case XXII Gwo 22/11).

 

We are prepared to continue publishing court decisions. We also consider taking steps as drastic as those taken by our opponents, consisting in informing of verdict which are not yet valid.

 

As regards the waiver of the claims by Dariusz Michalczewski, we expected the delivery of valid decisions, while our opponents provided the media with non-valid information, which the Court of Appeal in Gdańsk will have to

The plant has been built in Niepołomice Special Economic Zone near Kraków.

Tiger created the first Energy Water in Poland! Tiger Energy Water includes caffeine, taurine and B-group vitamins. Additionally, due to a very small amount of carbon dioxide, it is slightly sparkling, which gives the Tiger water an outstanding refreshing effect.
